Tidy Cyber

Terms of Service

DRAFT. Not legal advice. Chris Kirby must review this, ideally with a solicitor check, before going live. Items in [brackets] need completing.

  1. Who we are. Tidy Cyber ("the Service", tidycyber.co.uk) is run by Chris Kirby, a sole trader. Contact address: Chris Kirby, trading as Tidy Cyber, 9 Appledore Road, Brighton, BN2 4PT, England ("we", "us"). Contact: [email].
  2. The Service. An automated, passive check of publicly visible configuration of internet domains (DNS records, TLS certificates and protocols, HTTP responses and headers), producing a score, findings and suggested fixes. Paid options: a one-off full report (£29), and, as an optional upgrade once you have bought a full report, monthly monitoring subscriptions: Monitoring (£12/month, 1 domain: a fresh full report every month, quiet weekly change alerts and dashboard), available for a domain that already has a paid full report; and Monitor+ (£39/month, up to 5 domains with the same features, including a full report for each domain every month and quiet daily change alerts), which can be bought without first buying a full report. Prices include/exclude VAT: [state VAT status].
  3. Not certification. The Service is not Cyber Essentials or Cyber Essentials Plus certification, an audit, a penetration test or a guarantee of security. See our Disclaimer.
  4. Your authorisation. You may only submit domains you own or are authorised in writing to manage. You must complete our DNS verification. You must comply with our Acceptable Use Policy.
  5. Payments. Payments are processed by Stripe. Subscriptions renew monthly until cancelled. You can cancel at any time, effective at the end of the current billing period.
  6. Consumer cancellation rights. If you are a consumer, you have 14 days to cancel under the Consumer Contracts Regulations 2013. By requesting immediate delivery of a digital report you agree that the service starts at once and that you lose the right to cancel once it is fully supplied. [Confirm checkbox wording at checkout.] Most customers are businesses, to whom these consumer rights do not apply.
  7. Accuracy. Results reflect publicly visible information at the time of the check and may contain false positives or negatives. You are responsible for any changes you make to your systems.
  8. Liability. Nothing limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law. Otherwise our total liability to business customers is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential loss, loss of profit or data, or for security incidents you suffer. [Solicitor to review the limits and their reasonableness under UCTA 1977.]
  9. Availability. We may change or suspend the Service. If we end a paid subscription we will refund any unused prepaid period.
  10. Suspension. We may suspend accounts that breach these terms or the Acceptable Use Policy.
  11. Law. These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction.
